This text is a draft and must be reviewed by legal counsel before publication. The limitation-of-liability provisions in particular require separate assessment against Article 115 of the Turkish Code of Obligations and the unfair-terms review under consumer legislation. The text does not take effect until the bracketed fields have been completed by the service provider.
These Terms of Use govern the use of the t3gemstone.org website. By using the site you are deemed to have accepted these terms.
Product sales made through the site are additionally governed by the Distance Sales Agreement. In the event of any conflict between the two texts, the Distance Sales Agreement prevails in respect of the sales relationship.
1. Parties and Acceptance

If you do not accept these terms, you should not use the site.

3. Definitions
Site: the website published at the t3gemstone.org domain.
Product: hardware products offered under the T3 Gemstone brand and their related software components.
Content: the text, images, video, technical documentation, trade marks and logos appearing on the site.
User: any natural or legal person visiting the site or carrying out transactions through it.
4. Use of the Site
The site is provided for the presentation of T3 Gemstone products, technical information, and the conduct of sales processes.
The user agrees to use the site in accordance with the law, good faith and these terms; to refrain from conduct that would obstruct the operation of the site or place an excessive load on it; not to attempt to circumvent security measures; and not to use automated data collection tools without permission.
The technical information provided on the site is for general information purposes. Assessing the suitability of the product for a particular application is the user's responsibility; in critical applications the user must separately test the product's suitability.
The service provider reserves the right to change the content, presentation and technical features of the site without prior notice.
5. Intellectual Property Rights
Unless otherwise stated, the rights in the design, text, images and other content on the site belong to the service provider or its licensors and are protected under Law No. 5846 on Intellectual and Artistic Works and related legislation.
Save for reasonable quotation rights with attribution, copying, reproducing, commercially exploiting or adapting the content without permission is unlawful.
"T3 Gemstone", "T3" and the related logos are protected as trade marks. Open-source licences grant rights in respect of software and hardware design; they do not grant any right to use the trade marks. Use of the marks and logos is subject to separate written permission.
6. Open-Source Licences
T3 Gemstone software components are distributed under the open-source licences stated in their respective repositories. The T3 Gemstone SDK is released under the Apache License 2.0.
The rights and obligations relating to the use, reproduction and distribution of software components are determined exclusively by the applicable open-source licence. The licence text applicable to each component is included in that component's repository and, in the event of conflict, the licence text prevails over these terms.
The warranty and liability disclaimers contained in open-source licences apply in respect of the software licence. They do not in any way limit or exclude the non-conformity provisions of consumer legislation or your statutory warranty rights in respect of the hardware product you purchase.
The MMA (Matrix Multiplication Accelerator) unit on the TI AM67A processor operates exclusively with software supplied by Texas Instruments, in accordance with that company's licensing terms. This component is subject to the applicable third-party licence conditions.
7. Community and User Content
Community spaces such as the forum and code repository are provided through separate domains and are governed by those platforms' own rules of use.
The user who posts content is responsible for its lawfulness. Content notified or found to be unlawful is assessed within the framework of the obligations under Law No. 5651 and removed where required.
8. Third-Party Links
The site may contain links to third-party platforms such as documentation, the code repository and the forum. These links are provided for convenience only.
We have no control over the content, privacy practices or availability of linked sites and are not responsible for their content.
9. Limitation of Liability
Reasonable care is taken to ensure that the site operates without interruption or error; however, access may be temporarily suspended in cases of technical maintenance, infrastructure failure or force majeure.
The service provider's liability for indirect loss arising from its slight negligence is limited to the extent permitted by law.
This limitation does not cover the service provider's liability arising from its intent or gross negligence. Under Article 115 of the Turkish Code of Obligations, agreements made in advance excluding liability for intent or gross negligence are absolutely void.
Nothing in this section may be construed so as to limit or exclude the rights of users who qualify as consumers under Law No. 6502 on Consumer Protection. The mandatory provisions of consumer legislation are reserved.
10. Commercial Electronic Messages
Newsletters and promotional commercial electronic messages are sent only with your prior approval, recorded through the Message Management System (İYS).
You may refuse to receive further messages at any time and free of charge, through the link included in each message or through İYS.
11. Personal Data and Cookies

12. Amendments
These terms may be updated from time to time. The current text is published on this page and the date of last update is stated at the top of the page.
Continuing to use the site after amendments take effect means that you accept the updated terms. Sales contracts already concluded remain subject to the provisions in force on the date they were concluded.
13. Governing Law and Dispute Resolution
These terms are governed by Turkish law.
Users who qualify as consumers may bring disputes before the Consumer Arbitration Committees or the Consumer Courts, according to the applicable monetary thresholds. Further information is set out in the dispute resolution section of the Distance Sales Agreement.
For users who do not qualify as consumers, the Istanbul (Anatolian) Courts and Execution Offices have jurisdiction.
14. Entry into Force
These Terms of Use are in force as at the date of last update stated at the top of the page.
