Distance Sales Agreement and Pre-Contract Information Form

This text is a draft prepared on the basis of Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation (including the amendments of 24 May 2025, in force from 1 January 2026). As it is a binding consumer contract, it must be reviewed by legal counsel before it is published or connected to the order flow. The contract cannot enter into force until the bracketed fields (seller legal name, MERSIS, tax details, product price, carrier and return address) have been completed. This English text is provided for information; the Turkish text governs in the event of any discrepancy.
This text contains both the pre-contract information required under Article 5 of the Distance Contracts Regulation before an order is placed, and the provisions of the distance sales contract to be concluded.
You must read and approve this text before placing an order. Following your approval, the text is sent to you together with the order confirmation by e-mail, which constitutes a durable medium.
This contract is drawn up for sales in which the buyer qualifies as a consumer within the meaning of Law No. 6502. Buyers acting for commercial or professional purposes are not consumers; for those buyers the provisions of the Turkish Commercial Code and the Turkish Code of Obligations apply, and the sections relating to the right of withdrawal do not apply.

BUYER
The buyer's name, surname, delivery and invoice address, telephone and e-mail details are those notified by the buyer during the order and shown in the order summary.
2. Definitions
Law: Law No. 6502 on Consumer Protection.
Regulation: the Distance Contracts Regulation.
Product: the T3 Gemstone hardware product forming the subject of the contract, together with its accessories where applicable.
Durable medium: any medium (including e-mail) enabling information sent by or to the buyer to be recorded in a way that allows it to be examined for a reasonable period appropriate to its purpose and to be copied without alteration.
3. Subject of the Contract
The subject of this contract is the sale and delivery of the product whose characteristics and sale price are set out below, ordered electronically by the buyer through the seller's website at t3gemstone.org, and the determination of the parties' rights and obligations.
The buyer accepts that, before placing the order, they have been informed of and confirm the seller's legal name and contact details, the essential characteristics of the product, the total price including taxes, the payment and delivery arrangements, the conditions and period for exercising the right of withdrawal, and the available dispute resolution routes.
4. Product, Price and Payment Details
The essential characteristics of the product, the model ordered and the box contents are set out in the order summary and on the product page. The technical specifications published on the site form part of the pre-contract information regarding the essential characteristics of the product.
Product price: [PRODUCT PRICE] (including all taxes).
Shipping and delivery charge: [SHIPPING CHARGE]. The total amount payable is shown separately in the order summary, inclusive of taxes and any shipping charge.
Listed prices remain valid until updated; prices announced for a limited period remain valid until the end of the stated period.
Payment is made by the methods offered in the order flow, through secure infrastructure operated by [PAYMENT SERVICE PROVIDER]. Card details are not stored by the seller.
Where payment is not approved or is cancelled by the relevant bank or payment institution, the seller's obligation to deliver ceases.
5. Confirmation of Pre-Contract Information
The buyer accepts that they have read, understood and electronically confirmed all of the pre-contract information contained in this text before placing the order.
The order step giving rise to the payment obligation is marked so as to be clearly understood by the buyer.
The burden of proving that the pre-contract information was provided rests with the seller. The pre-contract information text and the contract are sent to the buyer's e-mail address together with the order confirmation.
6. Delivery
The product is delivered to the address notified by the buyer during the order, through [CARRIER].
The delivery period is no more than 30 days from confirmation of the order. Where the seller understands that it will be unable to perform within this period, it informs the buyer and refunds the amount paid within 14 days.
Where the buyer is absent at the time of delivery, it is the buyer's responsibility to collect the product following the notification left by the carrier.
The buyer is obliged to inspect the product on delivery and, where visible damage to the package is identified, to have a report drawn up and to refuse delivery. Products accepted without such a report are deemed undamaged.
The risk of loss or damage passes to the buyer upon delivery of the product to the buyer or to a third party designated by the buyer. Where the carrier has not been designated by the seller, risk passes to the buyer upon delivery to the carrier.
7. Right of Withdrawal
The buyer has the right to withdraw from the contract within 14 days of the date of delivery, without giving any reason and without paying any penalty. The buyer may also exercise the right of withdrawal in the period between conclusion of the contract and delivery.
Where more than one product has been purchased in a single order, the period begins on the date the last product is received.
Notice of withdrawal may be given within the period in writing or by durable medium, to support@t3gemstone.org or to the postal address above. It is sufficient that the notice is dispatched within the period.
Within 14 days of receiving the notice of withdrawal, the seller refunds all payments collected, including delivery costs, in a manner appropriate to the payment instrument used by the buyer at purchase and without imposing any cost on the buyer.
The buyer is obliged to return the product to the seller within 14 days of the date on which notice of withdrawal was given.
During the withdrawal period the buyer is obliged to use the product in accordance with its operation, technical specifications and instructions for use. The buyer is liable for any loss of value arising from use otherwise than in that manner. Ordinary inspection carried out to check the nature and functioning of the product does not constitute loss of value and does not extinguish the right of withdrawal.
Where information on the right of withdrawal has not been provided in due form, the withdrawal period is extended by one year in accordance with the Regulation.
8. Cases in Which the Right of Withdrawal Cannot Be Exercised
Under Article 15 of the Regulation, the right of withdrawal cannot be exercised in certain contracts, including: goods prepared in line with the buyer's requests or personal needs; goods whose return is not suitable for reasons of health and hygiene once their packaging has been opened after delivery; goods which, by their nature, become inseparably mixed with other items after delivery; books, digital content and computer consumables whose packaging has been opened; and services performed instantaneously in electronic form together with intangible goods delivered instantaneously to the consumer.
The T3 Gemstone development board sold in its standard configuration does not fall within these exceptions and is subject to the full 14-day right of withdrawal.
The exception concerning computers, tablets and similar devices, which was raised at one point, was removed from the legislation before it entered into force. The fact that the product's box has been opened does not, by itself, extinguish the right of withdrawal.
Where the buyer requests a custom configuration in the order, whether the relevant product falls within an exception to the right of withdrawal is notified separately in the order summary.
9. Return Procedure and Shipping Costs
Returns are sent through [CARRIER], as stated in the pre-contract information, to [RETURN ADDRESS].
Where the return is made using the carrier designated by the seller, no return shipping charge is collected from the buyer. Where no carrier has been designated in the pre-contract information, no return cost may be claimed from the buyer under any circumstances.
Where the designated carrier has no branch in the buyer's locality, the product is collected from the buyer's locality by the seller and at the seller's cost.
The product being returned must be sent complete, together with its invoice and any accessories.
These provisions on return conditions are independent of, and do not limit, the statutory rights available in respect of non-conforming goods.
10. Non-Conforming Goods and Warranty
Where the product delivered is non-conforming, the buyer may exercise one of the rights set out in Article 11 of the Law: withdrawal from the contract, a reduction in the sale price, free repair, or replacement of the product with a conforming equivalent.
The limitation period for liability arising from non-conformity is two years from the date of delivery, unless a longer period is provided for.
The provisions on non-conforming goods are independent of the right of withdrawal, and the expiry of the withdrawal period does not affect those rights.
The scope and duration of the warranty and the authorised service details are set out in the warranty certificate supplied with the product.
11. Default
Where the buyer defaults on payments made by credit card, the buyer's liability towards the bank continues within the framework of the credit card agreement between the cardholder and the bank.
In the event of the seller's default, the buyer may terminate the contract and claim a refund of the amount paid.
12. Protection of Personal Data
Detailed information on the personal data processed in connection with the order is set out in the Personal Data Protection and Privacy Policy.
In accordance with Article 20 of the Regulation, the seller retains records relating to withdrawal, information provision and delivery for at least three years.
13. Complaints and Dispute Resolution
The buyer may submit complaints and requests concerning the contract to support@t3gemstone.org or through the contact channels set out above.
In consumer disputes, the monetary thresholds redetermined each year by the Ministry of Trade apply. For 2026, disputes below TRY 186,000 may be brought before the Consumer Arbitration Committee at the buyer's place of residence or the place where the transaction was carried out; disputes above that amount may be brought before the Consumer Court.
Under Article 73/A of Law No. 6502, applying to a mediator before bringing proceedings is a procedural precondition for disputes heard by the consumer courts.
The buyer may also submit applications through the Consumer Information System (TÜBİS) available on e-Devlet.
14. Entry into Force and Confirmation
This contract is concluded and enters into force when the buyer confirms the order electronically and payment is made.
A copy of the contract is sent to the buyer's e-mail address together with the order confirmation and may be retained by the buyer.
By approving this contract, the buyer declares that the pre-contract information was provided in due form and that they accept the provisions of the contract.
